Amber Heard’s insurance company refuses to pay Johnny Depp settlement

After seven long weeks in the courtroom in Fairfax County, Virginia, the jury announced a verdict in the libel trial of Johnny Depp and Amber Heard on June 1, 2022.

The court found that Heard defamed Depp by publicly accusing him of domestic abuse. The jury found that Depp had proven Heard had lied about his allegations.

In Heard’s countersuit against the Pirates of the Caribbean (2003) star, the jury found that Depp’s former attorney, Adam Waldman, publicly defamed her. Heard now owes Depp $15 million. Depp owes Heard $2 million in compensatory damages.

However, Heard’s insurance company, The New York Marine and General Insurance Company, filed a lawsuit against the Los Angeles resident in the U.S. District Court for the Central District of California on Friday.

According Law and Crime Network, the company insured Ms Heard from July 18, 2018 to July 18, 2019 – a period that includes the Op-Ed Heard written in The Washington Post it was the basis of Mr. Depp’s lawsuit against her.

The New York Marine and General Insurance Company lawsuit includes three claims:

(1) that she be released from any obligation to pay for her defense in a recent defamation case by her ex-husband Johnny Depp(2) that it not be required to pay the multimillion-dollar judgment that Depp won against it, and (3) that it not have to pay the costs of ongoing litigation associated with a call.

Depp filed his lawsuit on March 1, 2019, while Heard was insured by the New York Marine and General Insurance Company. The company, however, says Heard was only insured for $1 million and the libel suit is not covered by their policy.

The company notes that insurance policies may cover acts of negligence, but “an insurer is not liable for any loss caused by the willful act of the insured[.].” Since the jury found Heard deliberately defamed Depp, the company says it was a “deliberate” act that it had to pay for itself.

While the insurance company was willing to pay attorneys through the Cameron McEvoy law firm, that firm withdrew from Heard’s case in November 2020 and Heard did not seek approval from the insurance company to change lawyers.
